Any reproduction, representation, modification, publication or adaptation of all or part of these elements, by any means or process whatsoever, is prohibited without the prior written consent of the Domaine. Any unauthorised use constitutes an infringement punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.

The website may contain links to third-party websites. The Domaine has no control over these websites and accepts no liability for their content. Linking to this website from any website that distributes unlawful content or is primarily aimed at minors is prohibited.
Article 6: Personal data
Domaine du Haut Bourg processes the personal data of its customers and website visitors in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and the amended French Data Protection Act No. 78-17 of 6 January 1978.

The following processing operations are carried out:
Management of orders, delivery and customer relations (performance of the contract): retained for the duration of the business relationship, then five years for evidential purposes; accounting records retained for ten years.
Verification that the buyer is of legal age (legal obligation prohibiting sales to minors): declaration collected when ordering and retained with the order.
Contact form (legitimate interest in responding to enquiries): retained for three years from the last contact.
Newsletter (consent): retained until you unsubscribe, or for three years without any interaction on your part.
Website audience measurement (consent where required): retained for a maximum of twenty-five months.
The data is intended solely for the Domaine’s departments and its processors, who act only on instruction and for the purposes of the service concerned: Framer B.V. (website hosting), Shopify International Limited (online shop and payment), Brevo (newsletter delivery), the carrier responsible for delivery and the website audience measurement tool.
Some service providers, or their own processors, may process data outside the European Union, in particular in Canada and the United States. These transfers are governed by an adequacy decision of the European Commission or by the standard contractual clauses it has adopted.
No data is sold, rented or transferred to third parties for commercial purposes. The website is not intended for minors.
Article 7: Your rights over your data
In accordance with Articles 15 to 22 of the GDPR, you have the right to access, rectify and erase your data, to restrict and object to its processing, and the right to data portability. Where processing is based on your consent, you may withdraw it at any time, without affecting the lawfulness of processing carried out before its withdrawal.
You may also set out instructions regarding what happens to your data after your death.

Article 8: Cookies and audience measurement
A cookie is a file placed on your device when you visit the website. It ensures the website works properly, remembers your preferences and, where applicable, measures its traffic.
Cookies that are strictly necessary for the website to work and for managing the basket are placed without prior consent, in accordance with Article 82 of the French Data Protection Act.

Article 9: Contact forms and newsletter
The information collected through the contact form is sent to Domaine du Haut Bourg and retained for three years from the last contact. It is used solely to respond to your enquiry.
Newsletter subscription is reserved for persons of legal age. It is based on your consent, given through a positive action on your part. Each message includes an unsubscribe link allowing you to withdraw this consent at any time.
Mandatory fields are indicated when filling in the form. If they are not completed, the request cannot be processed.
Article 10: Governing law and dispute resolution
This website and its use are governed by French law.
In the event of a dispute, an amicable solution will be sought first. Consumers may use, free of charge, the consumer mediator to which Domaine du Haut Bourg is subject, under the conditions set out in Articles L.611-1 et seq. of the French Consumer Code. The mediator’s details are given in Article 24 of the terms and conditions of sale.
Failing an amicable resolution, the dispute may be brought before the competent courts. Consumers retain the option of bringing proceedings, at their choice, before the court of the place where they resided at the time the contract was concluded or the harmful event occurred.
